00:48:56 Christopher Yukins / GW Law: On publicprocurementinternational.com, please feel free to see an earlier program on the EU "Foreign Subsidies Regulation" (FSR), which addresses perceived foreign government subsidies by applying concepts developed under the EU "State Aid" doctrine. The FSR discussion puts the EU subsidies issue into clearer focus. 00:50:11 Christopher Yukins / GW Law: Tom McSorley and his colleagues joined me in an article, published through the Government Contractor, on the NATO DIANA process he is describing. That article is available on the page for this program, at publicprocurementinternational.com. 00:50:24 Maurice van Rooijen: On which fase do you connect with procurement? 00:52:18 Mark Johnson: What is the average budget allocated to this phase per project 00:57:16 Daniel Schoeni: Thanks to Maurice van Rooijen for the excellent question about the timing about the phasing. We would recommend the following article for a discussion of precisely that issue, which was coauthored by two of today's panelists: https://papers.ssrn.com/sol3/papers.cfm?abstract_id=5092438. 00:57:29 Filomena Vieira: How do you deal with IPRs with Opt-in Programme and "rapid procurement"? 00:58:33 Yokasta Guzmán Sanots: Primary Objective until now: To resolve public sector challenges through technological innovation, ensuring public ownership and influence over strategic innovations. 00:59:23 Yokasta Guzmán Sanots: Primary Objective: To stimulate the development of disruptive technologies relevant to NATO’s strategic needs, while respecting private ownership and ensuring interoperability among allies. 01:02:11 Christophe Veys: Could we have access to the tender documents i.e; Competitive dialogue to see and understand how the procurement with different phases, is structured? 01:03:03 Brenda Quiroz Maday: Professor Yukins, Can you please share the name of the article you referenced in your first message? 01:03:34 Rosamond Xiang: The components of many dual-use technologies are still oft manufactured out of non-NATO countries. How would DIANA’ss approach adapt to scale innovative solutions and protect their supply chain? 01:03:46 Christopher Yukins / GW Law: Brenda, please see Dan Schoeni's chat entry above, with a link to the article on SSRN.com. 01:04:14 Brenda Quiroz Maday: Thank you 01:08:57 Tom McSorley: RE: IPRs - DIANA does not restrict/take IPRs during Challenge Programme. For Opt-In and Rapid Procurement, IPRs would be negotiated but would not be based on background IP, including IP developed during Challenge Programme. IPR issues would come into play if the Opt-in programme or rapid procurement was structured as acquisition of development which could lead to negotiation of IPR. The recommended default IPR is to maximise commercialisation of the technology and keep IPRs in hands of innovator. 01:10:44 Tom McSorley: RE Supply Chain - DIANA supports innovators in developing their supply chains based on the procurement/security requirements of a given technology and market. For example, raw materials supply chain will have different market requirements than electronic components. DIANA does not impose its own supply chain restrictions but rather supports with view of the procurement and regulatory requirements of particular solutions/technologies. 01:11:23 Rosamond Xiang: Thank you, Tom. 01:17:54 Fabrizio Braghini: DPD 2009 81 does not cover all contracts since coop RD, G2G, Others are excluded; overall it covers around 1/3 of contracts. 01:18:33 Christopher Yukins / GW Law: On November 1, 2024, we held a webinar on the defense technology trade controls that Lucian is discussing, available on publicprocurementinternational.com. 01:26:17 Lucian Cernat: For the ReArm Europe/Readiness 2030 we can use the current procurement contractual tools that are available already at EU level via the current Defence Procurement Directive. For joint procurement there are specific instruments as well. For some concrete examples, you may also check the opportunities available under the European Defence Fund: https://defence-industry-space.ec.europa.eu/eu-defence-industry/european-defence-fund-edf-official-webpage-european-commission_en 01:26:43 Christopher Yukins / GW Law: There is a detailed discussion of the most recent National Defense Authorization Act (NDAA) -- and the FoRGED Act -- on publicprocurementinternational.com. 01:29:53 Christopher Yukins / GW Law: A separate Trump administration initiative is the "Revolutionary Federal Acquisition Regulation (FAR) Overhaul," which was launched by an Executive Order and is unfolding. The most recent update on that "overhaul" (from last night) is on publicprocurementinternational.com, as Sonia mentioned. 01:34:24 Daniel Schoeni: Thanks to Paige Niswonger for bookending our webinar with two excellent questions. We hope to get to her questions (and all of the other great questions posted) in the short time that remains. 01:35:05 Christopher Yukins / GW Law: Sandeep's summary is quite good. The CSOs are descendants of the U.S. government's "Broad Agency Announcements" which have long been used to canvass the technology available in the marketplace. 01:35:12 Lucian Cernat: Here's a concrete example of a EU-funded defence project: The Joint Air Missile Initiative in Europe. Link: https://ec.europa.eu/info/funding-tenders/opportunities/portal/screen/opportunities/projects-details/44181033/101198046/EDF 01:36:09 Ashley Carter: Are Memorandums of Understanding (MOUs) required when pursuing a joint initiative between the US Government and an International Government? 01:36:36 Giuseppe TEMPESTA: Good afternoon. Just 01:36:43 Giuseppe TEMPESTA: v 01:37:16 Ashley Carter: Although the FAR is not applicable to OTAs, are there regulations or laws that do apply to joint initatives internationally 01:39:10 Giuseppe TEMPESTA: All very interesting. Just a question. On which basis is an OTA budgetary estimated ? 01:39:56 Christopher Yukins / GW Law: To Ashley's question -- absolutely. One of the challenges in structuring solutions is in this area (such as for NATO DIANA) is to accommodate multiple jurisdictions' independent legal requirements -- and bedrock norms. 01:40:45 Marcello Sanguineti: Maybe the Overhaul of (FAR of) Trump Administration seems to be really revolutionary? 01:43:02 Allie Goebert: This has been an excellent webinar, thank you. 01:43:03 Kate Wolf-Vourazeris: Thank you for this discussion. 01:43:04 Shaun Scott: This webinar is an incredible achievement
